In the event that any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

XX. Warranty
The Ear Phone Connection (EPC) warrants all products for 1 year from the date of the original purchase. Wear and tear products (Fin Ultra Eartips, Torpedoes, Foam Pads, Clear Tubes, Rubber Earmolds, Elbows, and Ear Buds) are not covered under the Limited Warranty policy. The Limited Warranty is extended only to the original purchaser, and does not cover:
- Damage during Transportation
- Damage from tugging and pulling
- Improper Maintenance of unit
Any other misuse of the item such as excessive voltage, tampering with the unit, combining other parts other than authorized EPC parts, or repairs done by someone other than The Ear Phone Connection Repair Facility will void Limited Warranty. The Ear Phone Connection has the right to evaluate and refuse the warranty based on the evaluation.
In order for a customer to have the product repaired, exchanged, or credited based on warranty, the customer must present proof of purchase in the form of a SALES RECEIPT. The customer receipt will show evidence that the product is still a warranty item and will allow the customer to obtain warranty services.
XXI. Return Procedures
Dealer may return the product within a (30) day period for credit or a full refund (excluding shipping fees) from the date of purchase from EPC without incurring a 15% restocking fee. After the (30) day period and up to (90) days after the original date of shipment, a (15%) restocking fee will be deducted from the credit or refund provided by EPC. After the (90) day period from the date of purchase, EPC can no longer give a credit or a refund.
Contact a member of the EPC Technical Support Team by calling (888) 372-1888 and inform them of the problems you are experiencing. Our technicians will then work to better assist you on whether or not the product needs to be returned. If returning the product is necessary continue to the next step.
Our technician will provide you with a Returned Merchandise Authorization form and a Return Authorization number. Review the information on the form and make any necessary corrections. Note if you would prefer to exchange, replace or receive credit for the damaged product. If you choose to exchange the item and there is a price difference you will either be credited or charged the difference in product cost. Complete the form with a signature.
Return the product(s) with the completed RMA form. Also, you must include a copy of the SALES RECEIPT to validate the warranty. The Return Authorization number issued to you must be clearly marked on the outside of the package. Please allow 2-4 weeks for the product to be returned.

XXII. Avoid Hearing Damage
WARNING: Permanent hearing loss may occur if earpieces are used at high volume. Set the volume on your two-way radio to a safe level. You can adapt over time to a higher volume of sound that may sound normal but can be damaging to your hearing. If you experience ringing in your ears or muffled speech, stop listening and have your hearing checked. The louder the volume, the less time is required before your hearing could be affected. Hearing experts suggest that to protect your hearing:
- Limit the amount of time you use the earpiece at a high volume.
- Avoid turning up the two-way radio volume to block out noisy surroundings.
- Turn down the volume on the two-way radio if you can’t hear people speaking near you.
XXIII. Keep Out of Reach of Children
WARNING: The small parts included with this product can be a choking hazard. This product is not intended for use by children and should be kept away from children under 12 years of age.
CAUTION:
- Only use attachments and accessories specified by Earphone Connection, Inc.
- User assumes the risk if they attempt to use EPC products with other brands/model products.
- Risk of explosion if product batteries are replaced by an incorrect type. With Lithium-ion batteries, there is a risk of fire and burns.
- Do not force open, crush, heat above 60 degrees Celsius (140 degrees Fahrenheit), or incinerate.
- For greater comfort and safety, start at the lowest volume when using any of our products.

Earphone Connection, Inc. products are designed to produce a specific audio output level at maximum rated power. Modifying these devices in any way including adding or removing components and accessories may change the audio output of the device and could result in PERMANENT HEARING DAMAGE.
Many countries have regulations defining the amount of noise that an individual can be subjected to during a normal workday. Compliance is application-dependent and standards vary. It is the SOLE RESPONSIBILITY of the end-user to determine applicability and compliance to local hearing protection regulations.
Earphone Connection, Inc. strongly recommends that the radio is off before installation of audio accessory. Once the audio accessory is securely installed radio can be turned on. The radio volume switch is recommended to be set at a low position and adjusted once the radio is turned on.
